Marie Meza – Real Broker, LLC Copyright Policy

As a real estate brokerage affiliated with Real Broker, LLC (“Real Broker”), we understand the importance of protecting all forms of property, including intellectual property (IP). Real Broker does not tolerate the misuse or infringement of others’ IP on websites or systems owned, managed, or operated by or on behalf of Real Broker or its independent agents (each, a “Real Broker Site”).

Our agreements with those who use or post content to Real Broker Sites expressly prohibit the uploading, posting, emailing, or transmittal of any content or material that infringes on another party’s intellectual property rights. To enforce this policy and protect the rights of copyright holders, Real Broker provides a process for submitting complaints that content or material posted on a Real Broker Site violates U.S. copyright law.

Pursuant to the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), the full text of which is available at http://www.copyright.gov/title17/92chap5.html#512, Real Broker has implemented procedures for receiving Notices of Claimed Copyright Infringement (“Notices”) and Counter-Notices for erroneous claims.
All Notices and Counter-Notices must be truthful and submitted under penalty of perjury. Submitting a false Notice or Counter-Notice can result in personal liability. You may wish to seek legal counsel before submitting a Notice or Counter-Notice.

Real Broker reserves the right, in its sole discretion, to block or remove any content or material deemed objectionable or infringing. Regardless of whether such material is removed, Real Broker will make a good-faith effort to notify the user if a copyright complaint is made against them.


Notice of Copyright Infringement

If you have a good-faith belief that content or material on a Real Broker Site infringes upon a copyright you own or control, or that you are authorized to act on behalf of, you may submit a Notice of Infringement to our Designated Agent.

Your Notice must be in writing (email or letter) and include all of the following information:

  1. Your full contact information — name, email address, phone number, and mailing address.
    Note: Real Broker may forward your Notice, including personal information, to the individual who posted the allegedly infringing content.
  2. A description of the copyrighted work you claim has been infringed, including the name and contact information of the copyright owner if it differs from your own. When available, please include registration numbers and dates.
  3. A description of the infringing content or material on the Real Broker Site, along with its URL or specific location. Screenshots are helpful but not required.
  4. A statement that you have a good-faith belief that use of the content or material is not authorized by the copyright owner, its agent, or the law.
  5. A statement under penalty of perjury that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Your physical or electronic signature.

Counter-Notice

If you believe that a Notice of copyright infringement has been improperly submitted against you, you may file a Counter-Notice pursuant to Sections 512(g)(2) and (3) of the DMCA.
Your Counter-Notice must be in writing (email or letter) and include the following:

  1. Your full contact information — name, email address, phone number, and mailing address.
    Note: Real Broker may forward your Counter-Notice, including personal information, to the complainant.
  2. A description of the material that has been removed or disabled and the location at which it appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled due to mistake or misidentification.
  4. A statement of consent to the jurisdiction of the Federal District Court for the district where your address is located (or, if outside the U.S., the Federal District Court of the State of Texas) and that you will accept service of process from the complainant or their agent.
  5. Your physical or electronic signature.

Real Broker Procedure

Upon receiving a Notice, Real Broker will make a good-faith effort to forward it to the person believed to be responsible for posting the allegedly infringing content. Real Broker will use the information provided to determine whether to remove or disable access to the material in question.
If a Notice is incomplete, Real Broker has no obligation to act on it.

When a Counter-Notice is received, Real Broker will forward it to the original complainant. If Real Broker does not receive notice of a court action seeking to restrain the allegedly infringing content within ten (10) business days after forwarding the Counter-Notice, Real Broker may reinstate the content within ten (10) to fourteen (14) business days, unless technical limitations prevent doing so.

Real Broker is not an intellectual property tribunal and has no obligation to determine the validity of infringement claims. Parties involved are encouraged to resolve disputes independently. Real Broker may, however, use the information in Notices and Counter-Notices to decide whether to remove or disable material.
